"Felony criminal charges have been approved by @CookCountySAO against Jussie Smollett for Disorderly Conduct / Filing a False Police Report", Chicago P.D. Chief Communications Officer Guglielmi wrote on Twitter Thursday.
UPDATE: Jussie Smollett has officially been charged with disorderly conduct for allegedly filing a false police report.
A bail hearing is anticipated for 1:30 p.m. CT Thursday, prosecutors said. The men alleged that he paid them $3,500 to stage the January 29 hate attack, during whih he claimed to have been beaten by two strangers wearing red MAGA hats who put a noose around his neck. "Given these circumstances, we intend to conduct a thorough investigation and to mount an aggressive defense", Smollett's attorneys, Todd Pugh and Victor Henderson, said in a written statement.
Smollett, 36, came under scrutiny after anonymous law enforcement sources came forward claiming that the actor may have paid two men to stage the attack.
There had been skepticism over his account, but Smollett has maintained he had nothing to do with the alleged attack.
Smollett, who like his character Jamal Lyon is black and gay, said he was attacked by two masked men who yelled "this is MAGA country" during their alleged assault.
A knowledgable source close to the situation said Smollett is expected by Fox to finish his work on the series despite the controversy that erupted around Smollett after he reported to Chicago police that he was the victim of a vicious hate crime.
Former Cook County prosecutor Andrew Weisberg said judges rarely throw defendants in prison for making false reports, opting instead to place them on probation, particularly if they have no prior criminal record.

Smollet has not commented since, but his statement at the time of the incident said that he had deep concern with "certain inaccuracies" that had been spread.
Guglielmi confirmed that a search warrant was executed at the Chicago apartment where the men lived but did not have any information about exactly what police found. But he denied reports that said he told police the attackers wore "Make America Great Again" hats.
"At first, it was a thing of like, listen, if I tell the truth, then that's it - cause it's the truth", he said.
But Smollett's story appeared to unravel, and has since become a cautionary tale in an era where incomplete information is quickly spread via social media.
